The girl (and in your scenario the wife) took a picture of herself before being 18. Even if she had never shown it to anyone, she would still be labeled as being in possession of child porn if anyone ever found out. EVEN IF IT'S HER OWN PICTURE AND NO ONE EVER SAW IT.

I agree that there is nothing morally reprehensible about anyone taking pictures of their body, at any age. The problem is, the law gets to define morality for us, so if they find out, they can call it a crime. Which is why cops should not be allowed a lot of wiggle room with interpreting laws.

My example was intended to show how ridiculous the idea of child porn being inherently evil is. What is evil is exploitation and abuse. A 15 year old can be a dumb shit all she wants, and while to me this may make her socially repulsive, she isn't being immoral. What's immoral is taking advantage of her naiveness and immaturity to satisfy yourself sexually. But this begs the question: when is someone mature enough to decide their sexual partners?
